Standard LIMITED WARRANTY for Hardware Products

ADDIUM warrants the hardware product against defects in material or workmanship for a period of one (1) year from the date of the original retail purchase (the “Warranty Period”), when purchased directly from ADDIUM or an authorized ADDIUM distributor.

During the Warranty Period, if a defect arises in the product, and you follow the instructions for returning the product, ADDIUM will either (i) repair the product using new or refurbished parts; (ii) replace the product with a new or refurbished product that is equivalent to the product to be replaced; or (iii) refund all or part of the purchase price of the product. For purposes of this Limited Warranty, “refurbished” means a product or part that has been returned to its original specifications. This Limited Warranty applies, to the extent permitted by law, to any repair, replacement part or replacement product for the remainder of the original Warranty Period or for ninety (90) days, whichever is longer. All replaced parts and products for which a refund is given shall become ADDIUM property.

The Limited Warranty only covers issues caused by defects in material or workmanship during ordinary use; it does not apply where the product: (a) has been subjected to abuse, misuse, neglect, negligence, accident, improper testing, improper installation, improper storage, improper handling, abnormal physical stress, abnormal environmental conditions, or use contrary to any instructions issued by ADDIUM; (b) has been reconstructed, repaired, or altered by any party other than ADDIUM or an authorized ADDIUM distributor; (c) has been used with any third-party product, hardware or product that has not been previously approved in writing by ADDIUM; or (d) has otherwise been damaged due to customer acts or omissions.

REPAIR, REPLACEMENT OR REFUND OF THE PRODUCT AS PROVIDED UNDER THIS LIMITED WARRANTY SHALL BE CUSTOMER’S EXCLUSIVE REMEDY. ADDIUM SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGES, INCLUDING CONSEQUENTIAL, INDIRECT AND INCIDENTAL DAMAGES, ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE PRODUCT OR FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OR CONDITION ON THIS PRODUCT. EXCEPT TO THE EXTENT PROHIBITED BY LAW, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY.
